Участники заседания
В заседании приняли участие Председатель Собора Митрополит Агафангел, Архиепископ Георгий (Секретарь), Епископы Григорий (Заместитель председателя), Афанасий, Никон, Николай, Роман и Анфим. Архиепископ Иоанн и Епископ Кирилл участвовали в работе Собора по Скайпу. Также в Соборе участвовали члены Высшего Церковного Совета игумен Иоанн (Шмельц) и протоиерей Леонид Пляц.
Архиепископы Андроник и Софроний отказались прибыть на Собор, несмотря на отправленные им приглашения.
Архиерейский Собор удовлетворил прошение Епископа Владивостокского и Дальневосточного Анастасия (Суржика) и постановил принять его и возглавляемую им Дальневосточную епархию в состав Русской Православной Церкви Заграницей. Владыка Анастасий также принял участие в работе Архиерейского Собора.

Участники Собора пропели вечную память новопреставленному протоиерею Григорию Вильямс и обсудили сложившееся положение нашей Миссии на Гаити и в США. Также в первый день работы Собора его участники обсудили положение в Святой Земле, Южной Америке и Австралии. Собор констатировал всупление в силу решений Церковного Суда а также отказ подчиниться Постановлению Суда со стороны Архиепископов Андроника и Софрония. Собор выслушал Докладную записку Митрополита Агафангела, а также обсудил ряд других вопросов.
Заявление Архиерейского Собора РПЦЗ
В связи с утверждением группы сторонников Архиепископов Андроника и Софрония (именующей себя «Предсоборной комиссией»), которое ими размещено в средствах информации: «В наше время то, что мы считаем соборной Церковью, имеет вид раздробленных «осколков», не имеющих общения между собой», означающее, что Соборной Церкви, якобы, видимо не существует и она разделилась на осколки, Архиерейский Собор заявляет, что Русская Православная Церковь Заграницей не считает, что в наши дни Поместная Российская Церковь видимо не существует и состоит из осколков, не имеющих между собой евхаристического общения. Напротив, такое утверждение нами и всей Православной Церковью осуждается как еретическое в анафематизме экуменизму: «Нападающим на Церковь Христову и учащим, яко она разделися на ветви, и утверждающим, яко Церковь видимо не существует, но от ветвей и расколов, (…) соединитися имать во едино тело: Анафема».
Мы верим, что наш Архиерейский Собор под председательством Митрополита Агафангела и подведомственные Собору епархии, миссии, монастыри и приходы есть видимая и «неразрывная часть поместной Российской Православной Церкви, временно самоуправляющаяся на соборных началах».
Мы констатируем, что на сегодняшний день не существует объективных физических препятствий для канонической жизни Единой Российской Церкви (наличие линии фронта, закрытой государственной границы, открытых гонений на православных христиан и т.п.) и не существует «невозможности установить сношения с Архиереями соседних епархий» (Указ №362, п.4).
Мы также констатируем, что в наши дни, несмотря на неоднократные призывы, архиереями и священнослужителями, бывшими ранее в РПЦЗ, а ныне именующими себя «осколками», сознательно не выполняется п.2 Указа №362: «епархиальный Архиерей немедленно входит в сношение с Архиереями соседних епархий на предмет организации высшей инстанции церковной власти для нескольких епархий, находящихся в одинаковых условиях».
Нынешняя ситуация предусмотрена пунктом 9 Указа №362: «В случае крайней дезорганизации церковной жизни, когда некоторые лица и приходы перестанут признавать власть епархиального Архиерея, последний, находясь в положении, указанном в п. п. 2 и 6, не слагает с себя своих иерархических полномочий, но организует из лиц, оставшихся ему верными, приходы и из приходов — благочиния и епархии, предоставляя, где нужно совершать богослужения даже в частных домах и других приспособленных к тому помещениях и прервав церковное общение с непослушными».
Поскольку «церковное общение с непослушными» (то есть, «осколками»), отсутствует, мы вынуждены, со скорбью, констатировать между нами и существующими ныне «осколками», состояние раскола. Мы, как и вся Церковь, верим, что раскольники не пребывают в Церкви, а являются отпавшей ее частью.
В то же время, наш Архиерейский Собор всегда призывал и призывает сейчас, всех, кто раньше был в РПЦЗ, отставить попытки обоснования разделений, доходящие, как мы видим, до губительных еретических лжеучений, и, уповая на Бога, восстановить наше общее единство.
Да возстанем в единстве на делание Твое, Господи, и верно послужим Тебе! Да будет так!

Воззвание Архиерейского Собора РПЦЗ
Разсудив о ситуации, сложившейся в наших епархиях в Америке, Канаде и Российской Федерации, принимая во внимание то, что находящиеся на покое архиереи Андроник (бывший Сиракузский и Свято-Никольский) и Софроний (бывший Санкт-Петербургский и Северно-Русский) не признали Постановлений Церковного Суда о них, и, вопреки этим Постановлениям ведут себя как правящие архиереи. Архиепископ Андроник своими беззаконными священнодействиями, и, вместе с архиепископом Софронием, лже-учительством и административными действиями продолжая вводить в смущение паству, чем, согласно канонам, заслужили наказание вплоть до лишения священного сана. Учитывая то, что лукаво призывая к миру, они не желают вести переговоры со священноначалием РПЦЗ и отказались прибыть на Архиерейский Собор, а также делают всё от них возможное, чтобы не состоялось примирение в лоне Святой Церкви, стремятся учинить разделение, основываясь на еретическом лже-учении, специально для этого ими придуманным.
Исчерпав все возможности для достижения мира и согласия, Архиерейский Собор Русской Православной Церкви Заграницей принял решение предать их воле Божией с тем, чтобы они сами решили свою дальнейшую судьбу.
Архиерейский Собор призывает всех, поддерживающих архиепископов Андроника и Софрония оставить свои намерения устраивать самочинное сборище, именуемое ими «Всезарубежным Собором» и распустить так называемую «Предсоборную комиссию». Такое сборище, созываемое без благословения Архиерейского Синода, в случае его собрания, явится актом раскола и зримым свидетельством отпадения от Церкви. В случае созыва этого сборища, все, пожелавшие на нем присутствовать, засвидетельствуют, что, будучи предупреждены, сознательно и по своей воле отделяются от Церкви, что будет подтверждено со стороны Архиерейского Собора изданием Указов о запрещении в священнослужении архиепископов Андроника и Софрония, принявших участие в сборище священнослужителей – запрещением в священнослужении со стороны их законных правящих архиереев, а всех принявших участие в сборище мирян – отлучением от Св. Причастия, для чего издано специальное Соборное Постановление.
Архиерейский Собор призывает архиепископов Андроника и Софрония, а также всех поддерживающих их священнослужителей и мирян, отрекшись от еретического лже-учения о том, что Единая Церковь Христова в наши дни видимо не существует, а существует в виде разделившихся и не имеющих общения между собой «осколков», отказаться от бунта против законной Церковной власти, и приступить к подготовке настоящего законного Всезарубежного Собора, состоящего из всех архиереев, представителей епархий, клириков, монашествующих и мирян, через которых, по вере Церкви, только и может осуществиться Воля Божия.

Имели суждение: О состоявшемся Церковном Суде Архиерейского Синода над архиепископами Андроником и Софронием.
Постановили: Так как в течение двух недель с момента объявления судебного решения Преосвященным Андронику и Софронию от них не последовало заявления о намерении подать апелляционную жалобу согласно параграфу 77 Положения о Церковном Суде РПЦЗ, решение Суда Архиерейского Синода вступило в законную силу и не подлежит обсуждению в апелляционном порядке. Отметить, что Преосвященные Андроник и Софроний не выполнили решение суда и продолжили свои действия в качестве правящих архиереев.
Справка. Параграф 77 Положения о Церковном Суде РПЦЗ:
«Епископы, судимые судом Архиерейского Синода, имеют право в течение 6 месяцев после объявления им решения суда обжаловать это решение в апелляционном порядке перед Высшим судом ближайшего очередного Собора Епископов. О своем намерении подать апелляционную жалобу они должны заявить не позже 2 недель после объявления им судебного решения.»

Слушали: Докладную записку Председателя «О ереси схизмоэкуменизма».
Постановили: Группа верующих, возглавляемая Преосвященными Андроником и Софронием, опубликовала учение о том, что будто бы Православная Российская Поместная Церковь разделилась на равноспасительные и благодатные осколки, не имеющие друг с другом молитвенного, административного общения и общения в таинствах. И что будто бы эти осколки в своей совокупности составляют ПРЦ. Архиерейский Собор не может признать православным это учение, считая его, в данном случае, разновидностью ереси экуменизма. Кроме того, это учение противоречит Указу №362 ВЦУ Православной Российской Церкви, который обязывает разрозненные группы верующих создавать единое управление, а не оправдывать и умножать расколы. А с теми, кто противится созданию единого управления, Указ предписывает прерывать общение.

Имели суждение: О действиях и заявлениях Преосвященных Андроника и Софрония и поддерживающих их священнослужителей и мирян после Церковного Суда.
Постановили: 1. Призвать группу верующих, возглавляемых архиепископами на покое Андроником и Софронием, прекратить подготовку планируемого ими неканоничного собрания и распустить так называемую Предсоборную Комиссию. Предложить им участие в подготовке каноничного Всезарубежного Собора всей нашей Церкви в соответствии с Положением об РПЦЗ. 2. Предупредить их, что в случае нераскаянности, в самый момент начала их беззаконного сборища, которое они ложно именуют Всезарубежным Собором, священнослужители из их числа будут запрещены в священнослужении, а монашествующие и миряне отлучены от Святого Причащения. 3. Заявить, что все иерархические действия архиепископов Андроника и Софрония, совершенные в нарушение постановления Церковного Суда о почислении их на покой, недействительны. 4. Подготовить дополнительное обращение к верующим этой группы. 5. В случае факта собрания беззаконного сборища уполномочить Председателя и Секретаря издать указ, по поручению Архиерейского Собора, о запрещении в священнослужении всех принявших участие в данном сборище архиеереев РПЦЗ. Правящим архиереям поручается запретить в священнослужении подведомственных им клириков и отлучить от Причастия подведомственным им мирян, принявших участие в беззаконном сборище.

Постановили: В настоящее время наша Церковь насчитывает в Америке только одного архиерея – Преосвящ. Григория. В связи с этим отложить обсуждение проекта «Положения о Совещании на территории Южной и Северной Америки и Канады» до выяснения ситуации с другими архиереями.

Постановили: Утвердить решение Чрезвычайного Архиерейского Синода о временном окормлении Преосвящ. Григорием Канадской и Сиракузско-Никольской епархий. Поручить окормлению Преосвящ. Григория Миссию, с относящимися к ней общинами и приходами.

Имели суждение: О некоторых аспектах действий Председателя и Секретаря Синода в ходе их переговоров в США с архиепископами Андроником и Софронием в присутствии представителей ИПЦ Греции.
Постановили: Напомнить Первоиерарху и Секретарю Синода, что в случае необходимости принять решения, расходящиеся с прежними постановлениями Синода, они должны согласовывать это и ставить об этом в известность остальных членов Синода.

ROCA: Beginning of Meeting of the Council of Bishops 2016
In Odessa, in the Archangel Michael diocesan building, began the meeting of the Bishops’ Council of the Russian Orthodox Church Outside of Russia. The meeting was attended by the Chairman of the Council Metropolitan Agafangel, Archbishop George (Secretary), Bishop Gregory (Vice Chairman), Athanasius, Nikon, Nicholas, Roman and Anfim. Archbishop John and Bishop Cyril participated in the work of the Council via Skype. Also participating in the Council were members of the Supreme Church Council Abbot John (Smelic) and Archpriest Leonid Plyats.
Archbishops Andronik and Sofrony refused to come to the Council, despite invitations being sent to them.
The Bishops’ Council granted the request of the Bishop of Vladivostok and the Far East Anastasy (Surzhikov), and decided to accept him and the Far Eastern Diocese of the Russian Orthodox Church Outside of Russia led by him. Bishop Anastasy also participated in the work of the Council of Bishops.
The Council of Bishops adopted the following agenda:
1. Report of the President.
2. On the joining of Bishop Anastasy and the Far East diocese to ROCOR
3. Report of bishops on the situation in the dioceses.
4. On the Ecclesiastical Court held.
5. On the new non-Orthodox teaching.
6. On the actions and statements of very reverend Archbishop Andronik and Archbishop Sofrony and their supporting clergy and laity, after the Ecclesiastical Court.
7. Conference of the territories of North and South America and Canada.
8. Diocesan boundaries
9. On the Synodal building.
10. Synodal representation in Odessa.
11. On the composition of the Synod of Bishops.
12. Supreme Church Council.
13. The convening of the 6th All-Diaspora Council.
14. Replenishment of the episcopate.
15. Miscellaneous.
Council members sang the eternal memory of the deceased Archpriest Gregory Williams and discussed the current situation of our Mission in Haiti and the United States. Also on the first day of the Council, the participants discussed the situation in the Holy Land, South America and Australia. The Council noted the coming into force of the decision of the Ecclesiastical Court and the refusal to obey the order of the court by the Archbishops Andronik and Sophrony. The council listened to the memo by Metropolitan Agafangel, and discussed a number of other issues.
ROCA: Statement by the Council of Bishops
In connection with the declaration of the supporting groupof the Archbishops Andronik and Sofrony (calling itself «the Pre-Council Committee»), which they placed in the media: «At the present time, we believe that the conciliar Church has the form of splintered “fragments «, that have no communion with each other , meaning that the universal Church, allegedly,
apparently does exist, and it has divided into fragments; the Council of Bishops declares that the Russian Orthodox Church Outside of Russia does not believe that in our days the Local Russian Church apparently does not exist and is made up of fragments, not having Eucharistic communion between themselves. On the contrary, such a statement by us and the entire Orthodox Church is condemned as heretical in the anathema against ecumenism: «those who attack the Church of Christ by teaching that the Church is divided into branches, and confirming that the Church apparently does not exist, but from the branches and fragments (…) will be united into one body: Anathema «.
We believe that our Council of Bishops, chaired by Metropolitan Agafangel and subordinated to this Council – dioceses, missions, monasteries and parishes, is the visible and » inseparable part of the Local Russian Orthodox Church, which is temporarily self-governing under conciliar principles».
We note that to date there are no objective physical obstacles for canonical life of the One Russian Church (the presence of a front line, closed state borders, open persecution of Orthodox Christians, etc.) and there is no «failure to establish relations with bishops of neighboring dioceses» (Decree №362, paragraph 4).
We also state that in our days, despite repeated appeals to bishops and priests of the former ROCA, and now calling themselves «fragments», paragraph 2 of the Decree №362 : «the diocesan bishop immediately enters into relations with bishops of neighboring dioceses for the purpose of organizing a higher instance of ecclesiastical authority for several dioceses in similar circumstances. » is deliberately not being fulfilled.
The current situation is provided for by paragraph 9 of the Decree №362: «In the case of extreme disorganization of ecclesiastical life, when certain persons and parishes cease to recognize the authority of the diocesan bishop, the latter, being in the position indicated in paragraph 2 and paragraph 6, does not resign from his hierarchical powers, rather organizes parishes from the remaining faithful; from parishes — deaneries and dioceses; where necessary providing services to be conducted even in private homes and other prepared premises, and breaking ecclesiastical communion with the disobedient».
Since «ecclesiastical communion with the disobedient» (ie «fragments») is not present, with regret we are forced to state that between us and the now existing «fragments», there is a state of schism. We, like the rest of the Church, believe, that the dissenters are not in the Church, but rather a fallen- away part of it.
At the same time, our Council of Bishops has always called, and now calls, everyone who has previously been in the ROCOR, to put aside attempts to justify division, reaching, as we see, to destructive heretical false teachings; but to trust in God, and restore our common unity.
Let us arise in unity to do Thy works, O Lord, and faithfully serve Thee! May it be so!

Appeal Council of Bishops
After discussion about the situation in our dioceses in America, Canada and the Russian Federation, have taken into account, that retired bishops Andronik (formerly of Syracuse and St. Nicholas Monastery), and Sofrony (formerly of St. Petersburg and Northern Russian) have not recognized the Resolutions of the ecclesiastical Court concerning them, and are behaving themselves as ruling bishops contrary to these Resolutions.
Archbishop Andronik in his lawless ministry, and, together with Archbishop Sofrony, by false teaching and administrative actions are continuing to confuse the flock, which according to the canons, deserve the punishment of deprivation of the priesthood. Considering that they are cunningly calling for peace, they are unwilling to negotiate with the hierarchy of ROCOR and refused to come to the Bishops Council. They are doing all they can to prevent reconciliation taking place in the bosom of the Holy Church, aiming to inflict division, based on their especially invented false heretical teaching.
Having exhausted all possibilities for peace and reconciliation, the Council of Bishops of the Russian Orthodox Church Outside of Russia has decided to leave them to the will of God, so that they themselves may decide their own fate.
The Council of Bishops calls upon all people supporting archbishops Andronik and Sofrony, to abandon their intention to organize an arbitrary gathering, calling it the «All-Diaspora Council», and to dissolve the so-called «Pre-Council Committee». Such a gathering convened without the blessing of the Synod of Bishops, in the case of occurring, would be an act of schism and visible evidence of falling away from the Church. If this gathering is convened, all who wish to be present, testify that being warned, they have knowingly and willingly separated from the Church; which will be confirmed by the Council of Bishops by a decree prohibiting archbishops Andronik and Sofrony from serving, the prohibition from serving by their respective ruling bishop of all priests who take part in the unlawful gathering, and for all laity who participate — excommunication from Holy Communion; for which a special Conciliar Decree has been issued.
The Council of Bishops calls archbishops Andronik and Sofrony, and all their supporting clergy and laity, to renounce the heretical false doctrine that the One Church of Christ presently does not visibly exist, but rather exists in the form of separated fragments , which have no communion between each other, to abandon this rebellion against lawful Church authority, and to begin preparations for a genuine and lawful all-Diaspora Council, consisting of all the bishops, diocesan representatives, clergy, monastics and laity, through which only, according to Church faith, the will of God can be realized.

Discussed: The Ecclesiastical Court of the Holy Synod which was held regarding the case of Archbishop Andronik and Sophrony.
Resolved: Since two weeks from the announcement of the judgment, their Eminences Andronik and Sophrony did not follow up with a statement of intention to appeal under section 77 of the Regulations on the Ecclesiastical Court of the ROCA, the decision of the Ecclesiastical Court of the Synod of Bishops Court has come into force and is not subject to discussion in an appeal.It was noted that the Most Reverend Andronik and Sophrony have not complied with the decision of the court, and continue to conduct affairs as ruling bishops.
“Bishops sentenced by the Court of the Synod of Bishops have the right to file an appeal against the judgment before the supreme Court of the next regular Council of Bishops within six months after receipt of the Court’s judgment. They must communicate their intention to appeal within two weeks after receipt of the Court’s verdict.”

Discussed: The report of the Chairman “on the heresy of schism-ecumenism”
Resolved: The group of believers led by their Eminences Andronik and Sophrony have published a doctrine that the local Russian Orthodox Church has split into fragments which are equally saving and grace-filled, which however do not have prayerful, administrative communion or sacramental communion with each other. Further, that these fragments together constitute the Orthodox Russian Church.The Council of Bishops cannot accept this doctrine as Orthodox, and considers it a form of the heresy of ecumenism.Moreover, this teaching is contrary to Decree №362 regarding the Higher Church Authority of the Russian Orthodox Church, which obliges scattered groups of believers to create a unified management, instead of justifying, and multiplying schisms.As regards those who oppose the creation of a unified management, the Decree instructs to interrupt communion with such.

Resolved: 1.To call upon the group of believers, headed by retired Archbishops Andronik and Sophrony to discontinue the preparation for the uncanonical meeting planned by them, and to dissolve the so-called Pre-Council Committee.They are rather recommended to participate in the preparation of a canonical All-Diaspora Council of our entire Church, in accordance with the Regulations of the ROCOR.
2. To warn them that in the event of their lack of repentance, at the very moment of the beginning of their unlawful gathering, which they falsely call the All-Diaspora Council, those in priesty rank from among them will be banned from serving and monastics and laity separated from Holy Communion.
3. Make known that all hierarchical deeds of Archbishops Andronik and Sophrony, committed in violation of the decision of the Ecclesiastical Court to be retired, are invalid.
4. Prepare an additional appeal to the faithful of this group.
5. In the case that the lawless meeting takes place, the President and the Secretary are authorised to issue a decree on behalf of the Council of Bishops, on banning from serving the hierarchs of ROCA who participated in this gathering.The ruling bishops are instructed to ban from serving their subordinate clergy and separate from communion the laity subordinate to them who have taken part in the lawless gathering.
